Acceptance of Terms

American Disabilities Testing Association LLC (“Company,” “we,” “us,” or “our”) operates the website located at www.LSATaccommodations.com (the “Site”).

BY CLICKING “I ACCEPT,” CHECKING ANY BOX AGREEING TO THESE TERMS, OR BY ACCESSING, BROWSING, OR OTHERWISE USING THE SITE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY:

  • These Terms of Use,
  • Our Privacy Policy, and
  • Our Consent and HIPAA Notice (available at https://www.LSATaccommodations.com/consent-and-hipaa-notice)

(collectively, the “Terms”), as may be amended from time to time.

Your continued use of the Site after any updates constitutes your reaffirmation of your agreement to all of the above documents. If you do not agree to these Terms, you do not have permission to use the Site and must stop using it immediately.

ARBITRATION NOTICE. Except for certain kinds of disputes described in Section 19, you agree that disputes arising under the Terms will be resolved by binding, individual arbitration. BY ACCEPTING THE TERMS, YOU AND AMERICAN DISABILITIES TESTING ASSOCIATION ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION. Please refer to Section 19 for details.

Use of the Site and Eligibility

American Disabilities Testing Association helps users (“Users”) potentially obtain testing accommodation documentation by connecting them with independent licensed mental health professionals (“Providers” or “Clinicians”).

To use the Site, you must:

  • Be at least 18 years of age;
  • Reside in the United States;
  • Have access to a compatible device and stable internet connection; and
  • Be legally able to enter into these Terms.

By using the Site, you represent and warrant that you meet these requirements. We reserve the right to deny or terminate access at our discretion.

Limited Scope of Services; No Professional Relationship with American Disabilities Testing Association

American Disabilities Testing Association operates a platform that connects Users with independent licensed Clinicians. We do not provide medical, psychological, diagnostic, or clinical services. No doctor-patient, psychologist-client, or other professional relationship is created between you and American Disabilities Testing Association by using the Site.

Any professional relationship exists solely between you and the Clinician you consult. Clinicians are independent contractors and are solely responsible for their clinical judgments, documentation, and compliance with professional standards.

The content on the Site is for informational and educational purposes only and is not a substitute for professional medical or psychological advice.

Telehealth Services and Limitations

Services are provided primarily through secure telehealth (video or phone). You acknowledge and agree that:

  • Telehealth has benefits and limitations compared to in-person care.
  • Technology issues may interrupt or affect the quality of sessions.
  • The clinician’s ability to assess you may be limited by the virtual format.
  • Telehealth is not appropriate for all situations or emergencies.

You are responsible for ensuring you have a stable internet connection, a compatible device, and a private location for consultations. We are not liable for technical failures or interruptions caused by your equipment or internet service.

User Accounts and Access

To use certain features of the Site, you must create an account by providing accurate, current, and complete information, including your name and email address.

We use magic link authentication to grant you access to your account. You are responsible for maintaining the security of the email account associated with your Site account. If an unauthorized person gains access to your email, they may be able to access your account and information on the Site.

You agree to notify us immediately at info@lsataccommodations.com if you suspect any unauthorized access to your email account or to your account on the Site.

You may not create more than one account or use another person’s account. You must provide truthful, accurate, and complete information when using the Site. Inaccurate or incomplete information may result in suspension or termination of your access.

Licenses and Restrictions on Use

We grant you a limited, non-exclusive, non-transferable license to use the Site for your personal, non-commercial use only, subject to these Terms.

You agree not to:

  • Impersonate any person or misrepresent your affiliation;
  • Use the Site for any unlawful purpose;
  • Reverse engineer, decompile, or disassemble any part of the Site;
  • Upload or transmit harmful code, abusive, defamatory, or illegal content;
  • Violate the rights of others; or
  • Use the Site in any manner that exceeds the scope granted above.

User Content and Health Information

You retain ownership of any content you upload to the Site.

Health and Medical Information will be used solely to facilitate consultations, generate accommodation documentation, and provide the services you requested. We will not publish, sell, or publicly display your Health Information except in the limited case of a sale of the Company or substantially all of its assets (as described in the Assignment and Business Transfers section).

Other User Content (such as reviews or feedback) grants us a limited license to use it as reasonably necessary to operate and improve the Site.

Payment and Non-Attendance

By submitting payment, you agree that we may retain your payment if we make reasonable efforts to schedule a clinician appointment and you do not schedule or attend, or if you do not sign the required electronic documents.

Third-Party Services and Advertising

We use third-party services to operate the Site. We may share non-sensitive information with advertising partners (such as Facebook/Meta, Google, TikTok, and Instagram) for marketing and analytics purposes. We do not share health or disability-related information with advertising partners for advertising.

We use SignWell for electronic signatures. By using e-signing features, you agree to SignWell’s Privacy Policy and Terms of Service.

Website Links and Third-Party Tools

We are not responsible for third-party websites or services linked from or integrated with the Site.

Intellectual Property

All content on the Site is owned by or licensed to American Disabilities Testing Association and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

Account Deactivation and Termination

You may deactivate your account at any time by emailing info@lsataccommodations.com. We may suspend or terminate your access to the Site at any time, for any reason or no reason, in our sole discretion.

Right to Modify the Terms

We may update these Terms at any time. Continued use after changes are posted constitutes acceptance.

Assignment and Business Transfers

We may assign or transfer these Terms and any information we hold in connection with a merger, acquisition, sale of assets, or other corporate transaction. The new owner will assume our rights and obligations under these Terms.

Reviews and Testimonials

Reviews are for informational purposes only. Individual results vary. We do not guarantee any specific outcome.

Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

We do not guarantee that you will receive testing accommodations or that any Clinician will issue documentation.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICAN DISABILITIES TESTING ASSOCIATION AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim shall not exceed the amount you paid to us for services in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless American Disabilities Testing Association and its affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, any content you submit, or your interactions with Clinicians.

Dispute Resolution and Arbitration

Except for small claims court actions, intellectual property disputes, or requests for injunctive relief, any dispute arising out of or relating to these Terms or your use of the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association in Miami, Florida.

You and American Disabilities Testing Association each waive the right to a jury trial and the right to participate in any class action or representative proceeding.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

Testing and Diagnosis Disclaimer

ADTA is a platform that connects users with independent licensed clinicians for the purpose of obtaining documentation to support LSAT accommodation requests. We do not provide medical or psychological diagnoses.

Any evaluation or documentation provided by a clinician through our platform is intended solely for use in requesting LSAT or other testing accommodations. It should not be interpreted as a formal medical or psychological diagnosis for any other purpose.

If you have concerns about any clinical information you receive, we strongly recommend consulting your own licensed mental health professional for a comprehensive evaluation.

Dispute Resolution and Refund Policy

If your request for an LSAT accommodation is not approved by a clinician or by LSAC, we will first attempt to resolve the issue in good faith. If we are unable to resolve the matter, you will receive a 100% refund of your purchase.

By using this website and agreeing to our Terms of Use, you agree that any and all disputes arising from your use of the site or our services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in the State of Florida.

You further agree to waive your right to sue the Company in any court, whether individually or as part of a class action, collective action, or representative proceeding. This waiver applies to all claims, whether brought in your individual capacity or on behalf of others. For complete details, please refer to our full Terms of Use.
